Military Registration: Is It Always Possible to Cancel the ‘Wanted’ Status After Paying the Fine During Wartime

In the context of Ukraine’s declaration of general mobilization and wartime, questions regarding military registration and the ‘wanted’ status become especially relevant.

Conscripted individuals are required to adhere to regulations governing their status and responsibilities during military actions or mobilization.

Legal expert and attorney Victoria Kosyuk from the law firm ‘Murenko, Kuryavy and Partners’ explained to RBC Ukraine that the issue of removing the ‘wanted’ status after paying a fine remains complex.

She clarified that when individuals inquire with the Territorial Recruitment Centers (TCC) about their search status, they may receive responses indicating that the person has been subject to administrative responsibility under articles 210 and 210-1 of the Ukrainian Administrative Offenses Code.

This means there are two options for further action.

Kosyuk stated that if the person agrees with the cited administrative ruling, they can pay the fine via the mobile application ‘Reserve+’, after which the TCC and the police should notify that there are no grounds for administrative detention or delivery to military enlistment offices.

She added that sometimes, TCCs do not fully carry out the necessary steps to lift the search status, which is why it is important to be aware of your rights.

If the individual disagrees with the administrative decision, it is recommended to file a court administrative claim to cancel the ruling and close the case.

The statute of limitations for such appeals is only 10 days from the date of issuance, but if it is missed for valid reasons, it can be extended upon request.

Once the court rules in favor, the person should submit a statement to the TCC requesting the removal of the violation from their military records and informing the police that there are no grounds for detention.

The application must be accompanied by the court decision.

It is also important to remember that conscripts can find out the reason for their search through official state bodies or inquiries.
