Legal Aspects of Business Trips for Employees with Disabilities in Ukraine
In Ukraine, employment relations concerning employees with disabilities remain relevant and are governed by appropriate legislation that promotes equal opportunities for all workers.
According to the South-Eastern Interregional Department of the State Labor Service, employers have the right to send employees with disabilities on official business trips, provided they adhere to labor law regulations and recommendations from the Medical and Social Expert Commission (MS Ek).When organizing business trips, managers must consider the conclusions of the MS EK, which specify the employee’s capacity to perform professional duties under certain conditions.
This means that any assignment must be compatible with the individual’s capabilities and medical advice.
At the same time, Ukrainian law states that employees with disabilities are obliged to follow their employer’s order regarding business trips unless such trips contradict medical recommendations.
Refusing without valid reasons is regarded as a violation of labor discipline.Overall, Ukrainian legislation does not set prohibitions or special restrictions on sending employees with disabilities on business trips nor requires obtaining separate consent or permission from the employee.
This confirms the principles of equality and inclusivity in the workforce, ensuring the rights of persons with special needs and their opportunities for professional development.The relevance of this issue is increasing in the context of enhancing employment opportunities for people with disabilities and creating more favorable conditions for their participation in work activities.
