What you need to know about extending additional leave in case of child’s illness: legal aspects and recommendations
In Ukraine, labor relations are governed by relevant legislation, and many employees seek additional leave for various reasons, including caring for a sick child.
Experts from the South-Eastern Interregional Department of the State Labor Service explain that it is important to understand when and how such leave can be extended or transferred if a child falls ill.
According to the law, regular annual or social leave does not automatically extend if the child becomes ill during the employee’s leave.
As stated in part 7 of Article 20 of the Law of Ukraine ‘On Leaves,’ leave to care for a child can be transferred or extended if the child is sick, but the employee must submit a corresponding sick leave certificate.
This decision must be agreed with the employer and documented by order.
Employees have the right to choose whether to prolong or transfer their leave, but all actions should be properly recorded in employment documentation.
It is also crucial to remember that during an employee’s temporary incapacity for work, even if it coincides with their leave, dismissal is only possible based on legal grounds and with the employee’s consent.
