Reservation from mobilization: who has the right and who is left without it

In the conditions of the ongoing general mobilization in Ukraine and the introduced martial law, many men from 25 to 60 years old receive military summonses and can be mobilized into the ranks of the Armed Forces of Ukraine. At the same time, the opportunity to keep an employee in the company or institution, having received a reservation from mobilization, is not possible for everyone. The question of who exactly has the right to apply for this and what restrictions exist in this procedure, remains relevant. The information that was brought to the public by "Channel 24" helps to understand the nuances of the current rules and determine which enterprises and employees are entitled to reservation and for what terms it is provided. From April 1, 2024, updated rules for the reservation of military personnel came into force in Ukraine, which are aimed at protecting enterprises important for the state from the direct mobilization of their employees. This mechanism allows critically important sectors of the economy to postpone the mobilization of personnel according to appropriate justified criteria. Who can get a reservation? First of all, we are talking about employees who hold key positions in certain state structures and areas. These are: - civil servants of category "A", who are members of the management of government or administrative bodies; - medical workers of state hospitals who ensure the stable functionality of the healthcare system; - representatives of religious organizations and clergy; - employees of international organizations that have an official status in the territory of Ukraine; - employees of the energy, communications, defense-industrial complex, IT and digital technologies sectors that ensure the strategic security of the country. The duration of the reservation depends on the field of activity of the enterprise or institution. In particular, for critical companies that are mine action operators or are of strategic importance, the reservation can last up to 12 months. For employees employed in international organizations, it is for the entire period of the contract. As for civil servants and law enforcement officers, the reservation is provided for them specifically for the period of mobilization. Who cannot be booked? There are restrictions on the categories of employees who are not eligible for booking. This applies to: - those who are not officially employed or are in unofficial work; - those who are not on military registration or do not update their data in the relevant systems; - employees who receive a salary of less than 20 thousand hryvnias per month, with the exception of employees in the public sector, the medical sector and energy, where there are other standards; - those who are not included in the "Oberig" system - an automated system for booking military personnel. How to get the right to book? An enterprise or institution must meet several mandatory criteria to submit an application for booking: - the average salary of employees must be at least 20 thousand hryvnias; - no arrears in paying taxes and mandatory contributions; - additional indicators are export activity with a turnover of more than 32 million euros per year, tax payments in the amount of more than 1.5 million euros, the strategic importance of the enterprise for the state, etc. The reservation procedure usually takes several working days, however, the final deadlines may depend on the complexity of the verification and documentation. It is important to consider that the reservation is valid for the period specified by law and may be revised or canceled in the event of a change in circumstances or violation of the established rules. In general, the mobilization reservation procedure is an important tool for deterring critical enterprises from losing their human resources during the mobilization period. At the same time, it has clearly defined limitations and criteria that ensure a balance between the state's security needs and the need to maintain economic stability.
