Territorial Recruitment and Social Support Centers (ТЦК і СП) do not have legitimate authority to independently determine citizens’ fitness for military service, as this function is exclusively performed by the military medical commission (ВЛК)

The command of the Ground Forces of the Armed Forces of Ukraine stated this in response to a request from "Ukrainian Pravda," published as part of an investigation into the mechanisms of the mobilization system and the issues that arise during military unit recruitment. According to official information released by the communications department of the КСВ command, the authority to assess citizens’ health status and determine their suitability for service belongs solely to military medical commissions. The response specifies: "A citizen’s fitness for military service is determined exclusively by the military medical commission. No serviceman of the ТЦК і СП has the authority to independently declare a person suitable or unsuitable for service." This means that any decisions regarding the eligibility or incapacity for military service are entrusted to qualified medical specialists, and the process of examination is mandatory and strictly regulated. The consequences of such limitations are obvious and systemic. According to military personnel comments, cases of mobilizing citizens who prove to be unfit for service due to mental disorders, dependencies, or other medical issues are carefully investigated. If violations or inappropriate conclusions are found, those responsible are held accountable according to current legislation. This includes that facts of mobilizing individuals with serious medical or psychological conditions, including diagnosed dependencies, are considered violations of recruitment rules and regulations. Furthermore, the command of the Ground Forces monitors the adherence to the procedures for medical examinations of reservists. For instance, applications are submitted to the Medical Forces of the Armed Forces of Ukraine to verify the operation of external military medical commissions functioning at district ТЦК і СП. This acts as a safeguard to prevent potential abuses and violations in the process of determining military suitability, especially during active mobilization periods. Regarding the real situation, it should be noted that in 2022, the Commissioner for Human Rights of the Verkhovna Rada, Dmytro Lubinets, received 18 complaints, mainly from reservists and their families, concerning actions by ТЦК і СП during mobilization. In 2023, the number of such appeals increased to approximately 500, and in the first five months of 2024—more than 3,300 complaints. Since the beginning of 2025 alone, in this period, over 1,600 appeals have been addressed to Lubinets, indicating systemic problems in the recruitment processes and oversight of compliance with legal norms. This trend points to significant issues within the functioning of the mobilization system and the work of ТЦК і СП. Therefore, questions regarding the legitimacy and professionalism of assessing military suitability remain highly relevant and continue to be a subject of extensive discussion in society and the parliamentary community. Ukrainian human rights defenders and experts emphasize the need to strengthen oversight and compliance with legislation, ensure transparency of the process, and uphold the rights of reservists along with proper medical examinations.
